Member obligations
- Before ordering or purchasing Goods or Services from a Supplier on, or via, the MedicMall Platform, you should carefully review the Supplier’s qualifications, skills and experience in providing such Goods or Services. You should also carefully review the Supplier’s Terms and Conditions and any other relevant policies that are displayed on the Supplier’s Microsite Store before purchasing any Goods and Services. You acknowledge and agree that to the extent permitted by Relevant Laws:
- MedicMall makes no representations, warranties or guarantees in relation to the availability, continuity, reliability, accuracy, currency or security of the MedicMall Platform, the Goods or Services or any other ancillary products or services made available to you on, or via, the MedicMall Platform. You acknowledge that the Goods or Services or any other ancillary products or services made available to you on, or via, the MedicMall Platform are provided 'as is'; and
- it is your responsibility to determine that the Goods or Services or any other ancillary products or services made available to you on, or via, the MedicMall Platform, meets your specific needs and/or are suitable for the purposes for which they are used.
Delivery of Goods
- The Supplier will not dispatch Goods to a Member until payment has been confirmed. A Supplier will use reasonable endeavours to effect delivery of the Goods at the delivery address nominated by the Member in the order and by the scheduled delivery date displayed on the MedicMall Platform Site or on your order confirmation (as the case may be). Delivery dates are estimates only and are not binding on the Supplier.
- The risk of the Goods, including from loss, theft, damage or destruction of the Goods, shall pass from the Supplier to the Member on and from delivery to the Member’s nominated delivery address or otherwise in accordance with the Supplier Terms of Sale and any other relevant Supplier policies that are displayed on the Supplier’s Microsite Store.
- Title to the Goods passes from the Supplier to the Member when the Goods are paid for in full or as otherwise specified in the Supplier Terms of Sale and any other relevant Supplier policies that are displayed on the Supplier’s Microsite Store.
- If there is any inconsistency between this agreement and the Supplier Terms of Sale in relation to risk and title to the Goods, the Supplier Terms of Sale shall prevail to the extent of the inconsistency.
- The Member will ensure that any person who collects or takes delivery of the Goods on your behalf is authorised by you to do so.
Cancellation
- If a Member wishes to cancel any Goods or Services purchased on, or via, the MedicMall Platform, the Member must contact:
- the Supplier using the contact details displayed on the Supplier’s Microsite Store;
- MedicMall by email via the support email address on the MedicMall Platform,
- and the Member may be liable to pay a cancellation fee to the Supplier, by way of liquidated damages, in accordance with the Supplier’s cancellation and refund policy (Cancellation Fee). The Member should review the Supplier’s cancellation and refund policy as displayed on a Supplier’s Microsite Store before cancelling any Goods or Services purchased on, or via, the MedicMall Platform.
- If a Supplier cancels any order for the purchase of Goods or Services, the Member will receive a full refund of the Purchase Price paid (except where a Member breaches the terms of this agreement and/or the Supplier Terms of Sale and any other relevant Supplier policies displayed on the Supplier’s microsite store).
MedicMall Store Refund and Return Policy
1.0. This Clause does not apply to goods purchased by customers who are consumers within the meaning of the Australian Consumer Law and where the return is made because the goods do not comply with the consumer guarantees under the Australian Consumer Law.
2.0 All returns for refunds must be made within 5 business days of receipt of goods.
3.0 To the extent permitted by law, returns will not be accepted if:
- the Goods were delivered more than 5 business days prior to the request for return;
- the Goods are returned incomplete, or have been used;
- the Goods will not be accepted on a returned product(s) where the product(s) has been used, marked, taped, opened or otherwise tampered with by the Member;
- the Goods were not stored and/or shipped back to MedicMall in accordance with the manufacturer’s or MedicMall’s recommendations;
- the Goods are not normal MedicMall stock items and have been procured by MedicMall to meet a specific customer requirement;
- the Goods are not returned to MedicMall’s nominated warehouse;
- the Goods have expired.
4.0. Postage on the returned goods will be at the Member's expense, it is advisable to arrange for the goods to be sent registered post or with a tracking number so that missing parcels can be traced. We will not accept COD returns.
5.0. Warranty periods are based on the manufacturers’ warranty periods, terms and conditions. Terms of conditions differ per product and per manufacturer. Please see the manufacturer's website, or contact our customer service team.
6.0. Inspection and Returns
- This clause has effect subject to any contrary law that is not otherwise excluded by these Terms.
- You must inspect the Goods immediately upon Delivery and may only return the Goods if:
- they do not materially comply with the Order; or
- if permitted by law, including Australian Consumer Law.
- If any or all of the Goods delivered were damaged, defective, or incorrect when delivered, then you must give us a Written Notice of that fact within 3 Business Days after the Delivery Date.
- If you provide Written Notice in accordance with clause 10.3 above:
- we may require you to return the relevant Goods to us for our inspection and will reimburse you for your reasonable costs of returning them provided that, upon receipt of the returned Goods, we are satisfied that the relevant Goods were damaged, defective, or incorrect;
- and you establish to our reasonable satisfaction that the relevant Goods were delivered in a damaged or defective condition, your sole remedy shall be limited (as we may elect) to us offering to:
- replace the relevant Goods; or
- refund to you of the purchase price by the issue of a credit note or a credit card account refund against the return of the Goods;
- and you establish that we delivered the incorrect goods to you, we will offer to replace that Good with the correct Good at our cost.
- If we offer to give you a refund or replacement pursuant to clause 10.4 above, you must accept that offer by returning the relevant Goods to us in their original condition and packaging within 5 Business Days of receipt of our offer.
- If we extend an offer for refund or replacement, we will issue you a Return Goods Authorisation number which must be referred to and included with the relevant Goods when you return them so that we can match the Goods with the relevant entries in our systems.
- If you fail to give Written Notice in accordance with clause 10.3 above, the Goods shall be conclusively presumed to be in all respects in accordance with your Order and free from any defects that would be apparent on reasonable examination, and you shall be deemed to have accepted the Goods accordingly.
- Regardless of anything otherwise provided for in this clause 10, if you have an issue with Goods that we sourced specifically for you, we will only accept returns if those specifically sourced Goods are defective.
- Any warranty claims for defective goods will be dealt with in accordance with the manufacturer's policy or applicable legislation.
- Freight charges applied on the original invoice may not be credited.
- MedicMall reserves the right to charge freight, handling and/or restocking fees on all returns.
- Under no circumstances will Buy-In/Non-Returnable Goods be accepted for return unless they are damaged, defective or incorrect. Short-term expiry dates will be considered on a case-by-case basis. A "short term expiry date" is an expiry date no longer than 6 months from the date of invoice.
